SuperFunky Theme Business License Agreement

1. License Grant

This License Agreement (“Agreement”) is a legally binding contract between the purchaser (“You”) and the author (“Licensor”) of the SuperFunky Theme (“Theme”). By purchasing, downloading, or using the Theme, you agree to comply with the following terms and conditions.

Upon purchase, you are granted a non-exclusive, non-transferable, non-commercial license to install and use the Theme on one (1) website owned or directly operated by you.

2. Permitted Use

You may:

• Install and use the Theme on one (1) live website per purchase.
• Use the Theme for personal or internal business projects (i.e., not for resale, clients, or third parties).
• Modify the Theme for personal or business use, as long as it is not redistributed or monetized.
• Receive lifetime updates and support for the original purchased version.

3. Prohibited Use

You may NOT:

• Use the Theme on multiple websites without purchasing separate licenses.
• Use the Theme for client projects, freelance work, or commercial web development services.
• Sell, resell, sublicense, rent, or distribute the Theme in any form.
• Use the Theme as part of a website-building service, SaaS, or hosted platform.
• Include the Theme in marketplace products, themes, templates, or WordPress bundles.
• Share or distribute access to the Theme files, documentation, or updates.
• Use the Theme in a way that directly competes with the Licensor’s business.
• Remove or alter any copyright, branding, or license-related notices.

4. Commercial Use Restriction

This license explicitly prohibits any form of monetization using the Theme. You cannot:

• Use the Theme to create websites for paying clients.
• Charge users for access to a site built with the Theme.
• Build an e-commerce, membership, or paywalled site using the Theme.

If you require a commercial license for client work or monetization, you must contact the Licensor for a separate agreement.

5. Ownership & Intellectual Property

• The SuperFunky Theme remains the sole intellectual property of the Licensor.
• Purchasing the Theme does not transfer ownership—you are only granted a limited right to use it under this Agreement.
• Any unauthorized distribution or commercial use is considered license infringement and may result in legal action.

6. Support & Updates

• Support and updates are provided only to the original purchaser.
• Unauthorized distribution or multi-site use voids access to future updates and support.

7. License Termination & Compliance

• Any breach of this Agreement immediately terminates your license without a refund.
• Upon termination, you must delete the Theme from all installations and cease all usage.
• Licensor reserves the right to enforce compliance, revoke access, or pursue legal action if necessary.

8. Additional Licensing for Agencies & Developers

If you need:
✔ Multi-site use
✔ Client project permissions
✔ Commercial deployment rights
